Physician Payments Sunshine Act: Deadline for Review and Dispute Is May 15

The review and dispute period for the Physician Payments Sunshine Act ends May 15. Also known as Open Payments, the Physician Payments Sunshine Act aims to increase the transparency of interactions between health care manufacturers and care providers. It requires manufacturers of drugs, medical devices and biologics to report payments made to physicians and teaching hospitals to the Centers for Medicare and Medicaid Services (CMS).

Physicians who wish to dispute a payment must do so directly in the Open Payments system, which then alerts the manufacturer. This year, manufacturers have provided their contact information in the Open Payments system to assist physicians in resolving disputes. All resolutions must be submitted by the manufacturer to CMS by May 30.  

Physicians should also review reported research payments for which they are identified as a principal investigator. CMS uses its own criteria to define principal investigators, so co-investigators may be identified.

Viewing reported payments requires registering in the CMS Enterprise Portal and with Open Payments. Physicians who previously registered but have not logged into Open Payments within 180 days need to call the support desk at 1-855-326-8366 or email openpayments@cms.hhs.gov to reinstate the account.
