Medical Legal/Expert Witness Guidelines

  • Make sure that your contract with, and work for, the law firm does not inhibit your ability to perform your faculty duties in any way
  • Be aware that you should provide expert advice and testimony only. You may not engage in patient care or research under a private contract
  • Legal work that necessitates the use of a JHU laboratory requires an institutional agreement between JHU and the law firm for the use of the laboratory, equipment and materials
  • You cannot disclose confidential information that is proprietary to JHU
  • Make certain that your testimony is scientifically rigorous, fair and balanced
  • Be advised that the law firm cannot use the JHU names or logos without prior permission from the University*
  • As an expert witness, you cannot state or imply that you are representing JHU
  • If your engagement as a medical expert involves legal services being rendered by your consulting client (e.g., law firm) to a pharmaceutical, medical device, or medical services company or organization, you must report to the institution via the online disclosure system if you are conducting or proposing to conduct research that is sponsored by the company or organization or involves its products or services.
